Terms of Service

The terms under which JACE provides its remote construction support services.

These Terms of Service govern your use of the JACE website (jace.pk) and any services provided by JA Construction & Engineering. By engaging our services or using this website, you agree to these terms. Please read them carefully.

1. About JACE

JA Construction & Engineering (JACE) is a remote construction management consultancy based in Pakistan. We provide professional construction support services to contractors, developers and project owners in the UK, Europe and internationally. Our services are delivered entirely remotely.

2. Our Services — Important Scope Limitation

All JACE services are delivered remotely. This means:

The client remains responsible for the accuracy and completeness of all information provided to JACE. JACE accepts no liability for outputs based on inaccurate or incomplete client-supplied information.

3. Engagement and Service Agreements

Services commence upon agreement of a written proposal or service confirmation. The scope, deliverables, fees and timescales will be set out in the proposal. These Terms of Service apply to all engagements unless superseded by a separate written agreement signed by both parties.

Any changes to agreed scope must be confirmed in writing by both parties before additional work commences.

4. Fees and Payment

Monthly retainer fees are payable in advance at the start of each month. Fixed-fee service fees are payable as agreed in the proposal — typically 50% on instruction and 50% on delivery, unless otherwise agreed.

Invoices are due within 14 days of issue. Late payment may result in suspension of services. JACE reserves the right to charge interest on overdue amounts at 8% per annum above the Bank of England base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Cancellation and Notice Periods

All notice of cancellation must be provided in writing by email to info@jace.pk.

6. Intellectual Property

All documents, reports, schedules and deliverables produced by JACE remain the intellectual property of JACE until payment has been received in full. Upon receipt of full payment, ownership of deliverables transfers to the client.

The client grants JACE a licence to use any documents, drawings, data and information provided for the purpose of delivering the agreed services only.

7. Confidentiality

JACE treats all client information as strictly confidential. We will not disclose project information, commercial data or client identity to any third party without your written consent, except where required by law. A formal Non-Disclosure Agreement (NDA) is available on request and is signed before the commencement of any engagement as standard practice.

8. Limitation of Liability

JACE's liability to the client in connection with any engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim in the preceding 3 months.

JACE shall not be liable for any indirect, consequential or special losses, including loss of profit, loss of contract or loss of business, whether or not such losses were foreseeable at the time of engagement.

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

9. Professional Standards

JACE services are delivered by qualified professionals. However, our outputs should not be relied upon as a substitute for legal, financial or specialist engineering advice. Where a matter requires specialist professional input beyond our scope, we will advise you accordingly.

10. Website Use

The content on jace.pk is provided for general information purposes. While we aim to keep information accurate and current, we make no warranties about the completeness or accuracy of website content. Use of this website is at your own risk.

We are not responsible for the content of external websites linked from jace.pk.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or from a JACE service engagement shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise agreed in writing.

We choose English law because the majority of our clients are based in the UK and it provides a well-established, internationally respected legal framework for commercial disputes.

12. Changes to These Terms

We may update these terms from time to time. The date at the top of this page indicates the most recent revision. Continued use of our services after any changes constitutes acceptance of the updated terms. For ongoing engagements, material changes will be notified by email with 30 days notice.
